Terms of Service

Agreement to Terms

By downloading, accessing, or using the Mushin mobile application (the "App"), you agree to be bound by these Terms of Service (the "Agreement"). If you do not agree to these terms, please do not use the App.

Mushin is provided by Gallantin ("the Developer," "we," "us," or "our"). These Terms of Service govern your use of the App and all related services.

Service Description

Mushin is a Zen wisdom application that provides:

• Daily curated Zen quotes and teachings
• AI-powered contemplative practices and reflections
• An interactive AI conversational coach named Mu, powered by Anthropic's Claude API
• Personalized morning messages tied to each day's wisdom
• Notification scheduling for daily reminders

Features may be available as free or premium tier experiences, subject to our pricing at the time of use.

User Accounts

To use the App, you must create an account using a valid email address and password.

• Age requirement: You must be 13 years of age or older to use the App. If you are in the European Union or United Kingdom, you must be at least 16 years of age, or the minimum digital consent age in your country, whichever is higher.
• Account responsibility: You are responsible for maintaining the confidentiality of your password and account information. You agree to accept responsibility for all activities that occur under your account
• Accurate information: You agree to provide accurate, current, and complete information during registration and to update your information as needed
• One account per person: Each account is for personal use only. You agree not to share your account with others or use the account of another person
• Prohibited conduct: You agree not to create accounts using false or misleading information, or for fraudulent or harmful purposes

Subscriptions and Payments

The App offers optional premium features available by subscription.

• Pricing: Subscription prices are displayed in your local currency by the App Store or Google Play and may vary by region and offering
• Auto-renewal: Subscriptions auto-renew on a weekly, monthly, or annual basis (as selected) unless cancelled
• Billing: Subscription fees are billed through the App Store (iOS) or Google Play (Android). Your payment method is charged automatically on your renewal date
• Cancellation: To cancel your subscription, you must do so through your App Store or Google Play account settings. Cancellations must be made before the next billing date to avoid charges. The App does not process refunds directly
• No refunds: Except as required by law, all payments are non-refundable. Refund requests should be directed to the App Store or Google Play
• Changes to pricing: We may change subscription prices with 30 days' notice. Continued use of the App after notice constitutes acceptance of new pricing

AI Disclaimer and Wellness Boundaries

The App uses artificial intelligence (Anthropic's Claude API) to generate teachings, practices, and responses from Mu, the in-app companion. Mu is not a therapist, counsellor, doctor, or crisis worker. Please understand:

• Personal reflection only: All AI-generated content — including conversations with Mu, daily teachings, morning letters, and practice suggestions — is intended solely for personal reflection, contemplation, and spiritual exploration. It is not a substitute for professional care.
• Not mental health treatment: Mushin and Mu cannot diagnose, treat, or manage any mental health condition, including but not limited to depression, anxiety, PTSD, eating disorders, addiction, or psychosis. The App does not provide medical, psychological, psychiatric, therapeutic, legal, financial, or clinical spiritual care. Do not use Mu as a replacement for a licensed therapist, counsellor, doctor, or other healthcare provider.
• Not crisis support: Mu cannot provide crisis intervention, suicide prevention, or emergency assistance. If you are in crisis, having thoughts of suicide or self-harm, experiencing a mental health emergency, or in any immediate danger, do not use the App. Contact local emergency services (such as 000 in Australia, 911 in the US, 999 in the UK, or 112 in the EU), call a crisis line in your country, or go to your nearest emergency department immediately.
• Crisis resources: A non-exhaustive list of confidential crisis support: Lifeline Australia 13 11 14; 988 Suicide & Crisis Lifeline (US); Samaritans 116 123 (UK & ROI); Befrienders Worldwide (befrienders.org) for other countries.
• Accuracy not guaranteed: AI-generated content may contain inaccuracies, outdated information, or misleading statements. Mu may say things that sound confident but are wrong. We do not warrant the accuracy, completeness, or usefulness of any AI response.
• Your responsibility: You are solely responsible for evaluating the suitability and accuracy of AI-generated content before relying on it. If anything Mu says conflicts with guidance from a qualified professional, follow the professional.
• Wellness, not health: Mushin is a contemplative wellness app. It is not classified as a medical device, digital therapeutic, or healthcare service under any jurisdiction. No clinical claims are made.

Content and Intellectual Property

• Zen quotes: The daily Zen quotes and teachings in the App are curated from classical Zen texts and public domain sources. Attribution is provided where applicable
• AI-generated content: Content generated by the AI coach (Mu) is created for your personal use only. You may not republish, redistribute, or use AI responses for commercial purposes without express written consent
• Your content: You retain ownership of any reflections, notes, or messages you create within the App. By using the App, you grant the Developer a non-exclusive license to use your interactions (anonymized and aggregated) to improve the App and train AI models, in compliance with our Privacy Policy
• Developer rights: The App, including its design, code, and interface, is the intellectual property of Gallantin. You may not reverse-engineer, decompile, or attempt to extract the source code of the App

Prohibited Conduct

You agree not to use the App to:

• Engage in illegal, harmful, abusive, or harassing conduct
• Attempt to gain unauthorized access to the App or its servers
• Disrupt the normal functioning of the App through technical attacks, spam, or other malicious means
• Impersonate another person or entity
• Share explicit, abusive, defamatory, or hateful content
• Exploit the App for commercial purposes without authorization

Termination

Your right to terminate: You may delete your account and stop using the App at any time through the App Settings. Upon deletion, your data will be removed from our servers (see our Privacy Policy for details).

Developer's right to terminate: The Developer may suspend or terminate your account and access to the App if you violate these Terms of Service, engage in harmful conduct, or use the App unlawfully. Termination may be immediate and without notice in cases of serious violation.

Limitation of Liability

The App is provided "as is" and "as available." To the maximum extent permitted by law:

• The Developer disclaims all warranties, express or implied, regarding the App, including warranties of merchantability, fitness for a particular purpose, and non-infringement
• The Developer is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or AI-generated content
• The Developer is not responsible for any harm, loss, or damage caused by relying on AI responses, quotes, or practices from the App
• The Developer is not liable for service interruptions, data loss, or technical failures beyond our control
• In jurisdictions where liability cannot be disclaimed, the Developer's total liability is limited to the amount you paid for your subscription in the 12 months preceding the claim

Indemnification

You agree to indemnify and hold harmless the Developer, its owners, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms of Service
• Your use of the App in violation of applicable law
• Content you generate or transmit through the App
• Your infringement of any third-party rights

Changes to These Terms

We may update these Terms of Service from time to time. Changes will be effective immediately upon posting, with the updated "Last updated" date at the top of this page. Your continued use of the App after changes constitute your acceptance of the updated Terms. We encourage you to review these Terms periodically.

Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in England and Wales for the resolution of any disputes.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding the App, superseding any prior or contemporaneous agreements, communications, or understandings.

Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, or if not possible, severed. The remaining provisions will remain in full force and effect.

Waiver

The failure of the Developer to enforce any right or provision in these Terms of Service does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by the Developer.
